Due to the lawyers’ revelations, the detention centers are overcrowded, and many places are preparing to expand. Currently, in some detention centers, rooms that originally accommodated 12 people are crammed with up to 20 people, and people are sleeping shoulder to shoulder on the large beds.

As for the reasons for the “overcrowding of detention centers”, the reasons stated by these lawyers are roughly the same, which can be summarized as follows:

1. Economic pressure is high, and new types of economic crimes are frequent. Many people choose to take risks and engage in some gray or black industries, such as pyramid schemes, money laundering, and virtual currency fraud; enterprises also have increased illegal activities such as false invoicing and contract fraud due to reduced income.

2. Crackdown. This year, public security and procuratorial organs in many parts of the country have carried out crackdown activities, such as combating pornography, casinos, and new types of economic crimes, which are the key targets of crackdown.

3. “Legal behavior is minor crime”, “minor crime is serious crime”, for example, some behaviors that may not have been crimes are now likely to be defined as crimes, such as setting up illegal operations for small businesses, or gambling being defined as gambling.

Judging from the data released by the authorities, it can more or less confirm the views of the above-mentioned lawyers.

According to data released by the Supreme People’s Court, in the first half of this year, courts at all levels sentenced 788,000 effective defendants, an increase of 8.47% year-on-year. Among them, the proportion of prisoners sentenced to more than 5 years of imprisonment and serious crimes has decreased, and there were 686,000 criminals sentenced to less than 3 years of imprisonment, an increase of 9.66% year-on-year, accounting for 87.04%.

In addition, the Supreme Procuratorate also released data that in the first half of 2024, 367,000 criminal suspects were approved for arrest, an increase of 18.5% year-on-year.
