What most Chinese people today don’t know is: The ‘Regulations on Human Organ Donation and Transplantation (Draft)’ is the first revision in 16 years after the previous draft was released and implemented in 2007.
That is to say, for various comprehensive reasons in between, there was no revision passed for 16 years.
This revision changes the name of the regulations from ‘Transplantation Regulations’ to ‘Donation and Transplantation Regulations’, adding the word ‘Donation‘. The National Health Commission made the following explanation: *Highlighting the importance of organ donation, strengthening the praise and guidance for organ donation, adhering to the principles of voluntary and free of charge**, and improving the conditions and procedures for organ donation in accordance with the Civil Code.
In terms of improving the human organ donation system, the revision of the ‘Regulations’ adds a statement that the state encourages citizens to donate human organs after death. That is, ‘The state encourages citizens to donate human organs after death, and through the establishment of a human organ transplantation work system, carries out the publicity and promotion of human organ donation, determines the list of human organ transplant appointment holders, and organizes and coordinates the use of human organs.’
The revision of the ‘Regulations’ adds relevant provisions on the acquisition and allocation management of human organs. Medical institutions engaged in human organ transplantation perform human organ transplantation surgery and can charge the following fees: related medical expenses such as hospitalization and surgery incurred by human organ transplantation, managed in accordance with medical service price; and the organ acquisition related fees paid to the human organ acquisition organization, including human organ assessment, removal, preservation, maintenance, repair, allocation and transportation, etc.
What does this sentence mean?
In fact, it means that organ donors donating their organs is a voluntary, free of charge behavior. In principle, organ donors and their direct relatives cannot receive any compensation, but after organ transplantation, the ‘human organ acquisition organization‘ for organ donation and transplantation can charge organ acquisition related fees from patients who need organ transplantation.
So, what are the main organizations and participants in human organ donation and transplantation in China?
In addition to the functional departments of the national health-related organizations, the revised ‘Regulations on Human Organ Donation and Transplantation’ stipulates: ‘Further clarify and refine the responsibilities of the Red Cross Society in carrying out organ donation-related work, and stipulate that Red Cross Societies at all levels shall participate in and promote the publicity, registration, donation witnessing, and memorial work of human organ donation in accordance with the law.’
This actually provides a legal basis for the Red Cross Societies at all levels in China to better carry out human organ donation work.
The Red Cross Society of China has been a social welfare organization with excellent reputation for many years, but since the outbreak of the Guo Meimei incident in 2011, the reputation of the Red Cross Societies at all levels in China has been questioned by many ordinary Chinese people.

On June 21, 2011, a netizen named ‘Guo Meimei baby’ on Sina Weibo, who claimed to ‘live in a big villa and drive a Maserati’, was certified as ‘General Manager of China Red Cross Commercial’.
The Guo Meimei incident broke out as a result.

Because of the Guo Meimei incident, Zhao Lizhen, the vice president of the Shenzhen Red Cross Society, openly admitted that the public’s trust in the Red Cross Society had fallen to its lowest point in history.
Since the ‘Guo Meimei incident’, the special account for medical assistance funds of the Shenzhen Red Cross Society has received almost ‘0’ social donations. Apart from some pre-arranged designated donations, there was only one designated donation of 100 yuan to Wu Changkai in more than a month.

Since the implementation of the ‘Regulations on Human Organ Transplantation’ in 2007, China has initially established a human organ donation and transplantation work system that meets the national conditions. Posthumous organ donation by citizens has become the main source of transplant organs, and the number of donations and transplants ranks second in the world for organ and body donation, and the transplantation service capacity and quality have reached the international advanced level.
In fact, this is really not an easy task.
