According to the Huashang Daily’s Big Wind News, recently, the Intermediate People’s Court of Xining City, Qinghai Province, made a final ruling on the case of Mr. Sun being beaten by police officer Zhang and two involved auxiliary police officers, rejecting Zhang’s appeal and upholding the original judgment.
Case Review: Man intervenes when mother is scolded, dragged into women’s restroom and beaten
On the morning of August 29, 2022, Mr. Sun accompanied his mother, whose foot injury had just healed, downstairs for a nucleic acid test when the scan was abnormal. Community staff reported the incident to the police, and then Mr. Sun and his mother were taken to the Pengjiazai Police Station of the Chengxi Branch of the Xining Public Security Bureau.
During the interrogation by the police, Mr. Sun’s mother explained the reason to the police officer, and was scolded by police officer Zhang. Mr. Sun intervened to dissuade her, saying “Mom, don’t say it,” which angered Zhang.
Subsequently, Zhang and an involved auxiliary police officer forcibly dragged Mr. Sun into the women’s restroom on the first floor of the police station and beat him. Later, another auxiliary police officer entered the women’s restroom and kicked Mr. Sun. The three of them jointly beat Mr. Sun, causing him to be injured. According to judicial appraisal, Mr. Sun’s right scapula was fractured, and the degree of injury was classified as minor injury level two; he suffered head trauma accompanied by neurological symptoms, scalp contusion, and facial soft tissue contusion, constituting a minor injury.
The involved police officers and auxiliary police officers were sentenced in the first instance, and the police officer appealed.
On January 14, 2025, three police officers from the Pengjiazai Police Station of Xining Public Security were publicly tried for the first time.
On the morning of November 12, 2025, the People’s Court of Chengnan District, Xining City, Qinghai Province, publicly pronounced the verdict on the case of Mr. Sun being beaten by police officers and auxiliary police officers. The three police officers and auxiliary police officers were all sentenced for the crime of intentional injury: among them, the involved police officer Zhang was sentenced to 8 months in prison, to be executed immediately; the two auxiliary police officers were sentenced to 8 months in prison, with a one-year probation.
Mr. Sun said that it took three years from the time he was beaten to the current verdict, during which the court held two hearings, and finally waited for the judgment result.
Mr. Sun told reporters, “I felt mixed emotions when I saw Zhang (referring to the involved police officer) being controlled by the court police and arrested on the spot.” It is reported that at the sentencing scene, Zhang was not satisfied with the judgment and appealed.
Zhang’s grounds for appeal stated that the judicial appraisal opinion had contradictions and flaws, and it was impossible to determine the time of injury formation, and could not prove that his beating behavior had a causal relationship with Mr. Sun’s injury; he subjectively had no intention of intentional injury, and the victim violated the epidemic prevention and control regulations and used online public opinion to interfere with the judiciary, requesting the second instance to overturn the verdict or remand for retrial. His defense attorney also simultaneously pointed out that the subject of the involved judicial appraisal opinion was improper, the basis for the appraisal was insufficient, and it belonged to solitary evidence and should be excluded, and it could not be ruled out that Mr. Sun’s injury was caused by factors outside the case, and suggested declaring Zhang not guilty.
Final Ruling: Reject the appeal and uphold the original judgment
The Intermediate People’s Court of Xining City formed a collegial panel in accordance with the law and publicly heard the case on January 12, 2026.
