The thinking of maintaining stability is rampant. The most recent “proliferation” occurred in Tianshui, Gansu. Without the official cover-up and attempts to conceal the truth, it would be impossible to breed so many conspiracy theories, adding a touch of death to the already precarious food environment, and bringing its few remaining credibility to the brink of collapse.

I originally thought that domestic universities could be fair and play the role of a judge. After all, so many universities offer law schools. If the leaders don’t understand the law, it shouldn’t be difficult to find a few professors to demonstrate… However, the example of Wuhan University tells us that it is indeed not difficult to demonstrate, but it is useless.

This does not only refer to the example of false accusations. In reality, similar cases of “secret filming” are mostly handled coldly (there have been several this year, but the public relations capabilities of the school are too strong), unless you dare to make a fuss.

In summary, my evaluation of this matter is:

The female party’s brave act of defending her rights deserves praise, but after learning that it was a misunderstanding, she still pursued the matter relentlessly, bit back, and launched cyber violence… She should be ashamed of her actions and pay the corresponding price.

The male party’s approach is more enlightening—in contemporary society, should one be a submissive sheep, content to be slaughtered, or a sharp-edged wolf, not giving an inch, sacrificing small etiquette for great benefit.

The first instance result of the Wuhan University Library False Accusation Incident (originally a sexual harassment incident) has been released. The court ruled that: it cannot be determined that the male student Xiao Moumou committed sexual harassment against a specific object, and dismissed the accusations of the female student Yang Mou.

Many media outlets have commented on this as: a misunderstanding, both sides suffer… But at this point in time (the truth has come to light), the whole thing is far from as simple as “both sides suffer”—the male party is the real victim.

Let’s sort it out from the beginning, it’s a bit long (over 4,000 characters), those who want to see the conclusion can jump directly to the dividing line in the later text.

At 6:30 p.m. on July 11, 2023, Xiao Moumou, a freshman (freshman) of the School of Foreign Languages of Wuhan University in 2022, and Yang Mou (graduate student) from the same school were studying in the library of the Wenli Department, sitting opposite each other. During the self-study, Yang Mou noticed that Xiao Moumou had unusual behavior and believed that Xiao Moumou was masturbating in front of her, and then began to take videos from under the table to collect evidence.

In the next hour or so, Yang Mou took a total of 5 videos, totaling about 4 minutes and 50 seconds. She claimed that in the video, she saw Xiao Moumou rubbing his genitals through his pants, the action was continuous and very obvious.

Subsequently, Yang Mou confronted Xiao Moumou. During the confrontation, Xiao Moumou wrote a letter of apology as required by Yang Mou, and Yang Mou recorded the entire process.

The content of Xiao Moumou’s initial letter of apology was “I took a picture of my sister and violated her privacy.” Later, at the request of Yang Mou, it was changed to “I did something indecent to my sister in the self-study area on the second floor of the library, which made my sister feel disgusted. It was a mistake I made in a moment of impulse. It was my fault. I hope my sister will forgive me and I will never do it again.” .

The two recordings totaled about 16 minutes. In the recordings, neither party explicitly stated what “mistake” and “indecent things” specifically referred to.

At the same time, on the day of the incident, Yang Mou contacted Xiao Moumou’s counselor. Two days later (i.e., July 13), Yang Mou went to the counselor in person and asked Xiao Moumou to sincerely apologize in writing again, and to cancel all his qualifications for evaluation and recommendation for postgraduate studies, and recorded this negotiation process.

On September 21, Yang Mou inquired about the progress of the incident again. The counselor informed her that Xiao Moumou did not participate in the scholarship evaluation. However, it was later discovered that Xiao Moumou actually participated in the evaluation but was not selected.

On October 7, the counselor informed Yang Mou that the college needed to further investigate the incident, and Xiao Moumou’s parents hoped to resolve the problem in person. Two days later, Yang Mou met with the counselor alone. The counselor again conveyed the parents’ wish to meet and provide financial compensation, and also mentioned that because the matter involved two colleges, she hoped that the teachers from the female student’s college would come forward to communicate, and that the Foreign Languages College could not independently determine the nature of the behavior, and that a third party (such as the Security Department) needed to intervene.

Yang Mou said that out of friendship with her classmates, she did not choose to call the police, and handed over the video she took and Xiao Moumou’s letter of apology to the counselor. However, after the Foreign Languages College independently retrieved the on-site monitoring, it believed that it could not prove sexual harassment based on the existing evidence.

On October 10, the counselor informed Yang Mou by email that the college was doubtful about the nature of Xiao Moumou’s behavior, and the vice-principal of the Foreign Languages College hoped to meet to confirm the facts and communicate her demands. Yang Mou believed that these requirements would lead to the disclosure of her information, and because Xiao Moumou “his family is not short of money, and he is a local Wuhan person with power and influence,” she did not trust the Foreign Languages College to handle the incident fairly, justly, and openly.

On October 11, Yang Mou published an article in her own tone through the WeChat public account “Jingrong Yinbing”, detailing the incident, claiming that the school had not resolved the problem for three months. The article quickly reached 100,000+ views, triggering widespread online attention and public opinion discussions. Many netizens, without understanding all the facts, accused Xiao Moumou, and public opinion was almost one-sided.

On the day the online post was published, Wuhan University quickly established a working group to investigate the incident. That evening, Xiao Moumou’s mother took Xiao Moumou to the police station to report the case, claiming that she was defamed by Yang Mou and asked the police to investigate whether Xiao Moumou had committed sexual harassment.

On the evening of October 13, Wuhan University issued a notice on the school’s official website, stating that it had investigated the report and, in accordance with relevant regulations, gave Xiao Moumou, a 2022 undergraduate student, a demerit. However, the notice did not state Xiao Moumou’s specific violations of discipline, and this ambiguous handling method triggered a polarization of public opinion—some people supported the school’s “zero tolerance” attitude towards sexual harassment; others questioned the unclear basis for the punishment and the lack of a complete chain of evidence.

Because the notice did not disclose the details of the incident and Xiao Moumou’s specific behavior, Xiao Moumou’s family questioned the school. Four days later, Wuhan University issued a red-headed document of punishment, which mentioned “Xiao Moumou had indecent behavior in the corridor of the north gate of the library”.

Xiao Moumou’s mother said that she had appealed to Wuhan University regarding this punishment decision and attached Xiao Moumou’s medical records related to dermatitis. In addition, Xiao Moumou’s mother stated that the relevant person in charge of Wuhan University had repeatedly stated that sexual harassment could be ruled out, and if sexual harassment was determined, it would be clearly stated in the notice. The demerit was to cool down the public opinion at the time and was an emergency measure.

As the incident continued to ferment online, Xiao Moumou’s identity information was “doxxed”, photos were maliciously made into wreaths and portraits, and false rumors such as “second-generation officials” and “rich second-generation sexually oppressing female students” were spread.

Xiao Moumou was not only isolated and verbally abused by his classmates, but also showed suicidal tendencies multiple times. On October 17, 2023, he was diagnosed with “acute stress response” at the Wuhan Mental Health Center. By December 13, the diagnosis was upgraded to “post-traumatic stress disorder, accompanied by anxiety, depression, and hypochondria, with a suicide or self-harm tendency of 80%” .

Some netizens who believed the incident had “reversed” began to continuously insult and ridicule Yang Mou. Yang Mou was also troubled by cyber violence, her personal information was leaked, and she was accused of “false accusation” and “hype”, and her emotions were on the verge of collapse.

In June 2024, Yang Mou sued Xiao Moumou, demanding that Xiao Moumou publicly apologize in a provincial newspaper for 15 days and compensate for mental distress of 5,000 yuan… A year later, the first instance dismissed Yang Mou’s claim.

The incident has been basically sorted out. It is worth mentioning that Xiao’s mother published an article on February 4, 2024, which I personally think is relatively objective and worth reading.

Hello everyone! I am the mother of Xiao, the person involved in the “Wuhan University Library Incident”, and I especially thank everyone for paying attention to this matter.

For more than 100 days since the incident, our entire family has been under tremendous pressure and pain. In addition to silence, we have been running around various organizations and institutions to appeal for grievances, and we are also working on the intervention of comprehensive judicial channels, so we did not respond immediately.

In fact, after multiple communications and confirmations with the school, the college, the school’s relevant working group, lawyers, and other parties, after carefully reviewing the complete video recorded by the female student and the monitoring video of the Wuhan University Library preserved by the school’s security department, they have all denied “sexual harassment”. However, a large number of false information and malicious rumors on the Internet have triggered multiple rounds of Weibo hot searches, with a reading and dissemination volume of over 1 billion.

Under the malicious slander of public opinion, my son has suffered from severe post-traumatic stress disorder and even wanted to jump off a building multiple times. After being diagnosed by the Wuhan Mental Health Center, his current suicide or self-harm tendency is as high as 80%, and he is recommended to be hospitalized for treatment and take psychotropic drugs, which is very critical.

In addition, this incident has led to the leakage of the personal information of the counselor of the Foreign Languages College of Wuhan University and suffered an injustice. In addition to anger, I still want to express my apology to this teacher. For the accounts that fabricated false information on the Internet, we have already carried out evidence preservation and filing at the notary office, and included them in the scope of judicial rights protection.

These 100-plus days and nights are like a purgatory. This is naked cyber violence. The words of the people are terrifying, and they kill without a trace. But when we want to defend our rights, we have to sacrifice a large amount of privacy and time to fight against wanton insults and harm.

A mother is not the person to rely on, but the person who makes reliance unnecessary. A 19-year-old child, his life has just begun, I hope to make the truth clear, let him live with dignity in the sun, even if we have to sacrifice privacy.

1. Not “sexual harassment”

My son has atopic dermatitis caused by an allergic constitution and has suffered from eczema for many years. On the day of the incident, he was just scratching under the desk in the library through his clothes. On the night the female student posted online, we reported the case to the police immediately. We and the school and the police have all watched the monitoring video of the library on that day, and everyone believes that it is not sexual harassment. At the same time, the school, the security department, etc. have also reviewed the so-called recordings and videos of the female student, and they all determined that it was not sexual harassment (the above all have evidence preserved).

We have kept all of my son’s medication records and diagnostic records.

2. Why did you write a letter of apology?

Around 8:30 p.m. that day, when the female student asked my son to apologize, he repeatedly asked the reason and the female student’s demands. The female student always avoided the question, claiming that as long as he wrote a letter of apology, she would not make a fuss. At that time, my son didn’t know what exactly he had done to make the female student so angry. Therefore, under the misjudgment of “writing a letter of apology is enough” and “to avoid trouble”, he wrote that so-called letter of apology.

For many years, I have been telling my children, “Avoid trouble in public places and avoid intense conflicts with others. When you encounter problems, you don’t have to be too serious, it’s better to have one less thing.” Now, I think it is precisely this traditional concept of unlimited tolerance that has led to the one-sidedness of our education, and also made the child fall into timidity and weakness.

3. Punishment after refusing to communicate

The next day, we received a notice from the college that the female student, holding the letter of apology, demanded that he be severely punished in the name of “sexual harassment”, and then we knew what the other party was accusing.

On July 17, the college arranged for us to meet with the female student to clarify, but after we and the college leaders waited for a long time, the other party canceled the meeting. Helplessly, we once again explained the facts of eczema and other facts to the college, hoping to convey them. Unexpectedly, after the college communicated, the female student still did not give up and escalated the incident and demands, requiring the Foreign Languages College to cancel all the qualifications for my son’s awards and postgraduate recommendation during his undergraduate studies, and not to join the party.

In fact, according to the regulations of Wuhan University, except for expulsion, the validity period of other punishments does not exceed 12 months. The female student, in the absence of all facts supporting the punishment, put forward a punishment that far exceeded the regulations of the school. In this regard, the college repeatedly stated that the female student’s demands need more facts and evidence to support, and more investigation is needed.

However, the female student was unwilling to come forward to communicate, and did not pay attention to or cooperate with the investigation of the school and the police, and continued to escalate the incident. The facts were not recognized and she posted online, and it was the eve of the 130th anniversary of Wuhan University. The school gave a “demerit”. We repeatedly asked the school for the reason for the punishment. The school clearly stated that it was not sexual harassment, but did not give any further explanation.

It was this hasty punishment decision that triggered a flood of abuse, attacks, and rumors.

4. Regarding “using a fake name”

The female student claimed in the WeChat article that the fake name was left in the letter of apology. In fact, my son left his real name, student ID number, and mobile phone number, and at the strong request of the female student, he left the name and phone number of the counselor. Finally, in the published public account article, my son’s information was erased, leaving only the counselor’s name, and falsely claimed that my son used a fake name, publicly fabricating rumors, and also causing the counselor to be subjected to a large amount of malicious cyber violence.

5. Regarding “witnesses”: fabricating the testimony of on-site witnesses

The female student mentioned in the WeChat article that at the scene of the incident, “there was a male classmate who saw the whole process and was willing to testify”. However, the school and the police have found this witness and inquired about the situation at the scene. Whether facing the school or the police, the male student said that he only saw the process of the two sides arguing, and could not prove anything else.

6. Regarding “economic compensation”: purely fabricated and never mentioned

The female student mentioned in the WeChat article that “the counselor conveyed that Mr. x’s father hoped to give me economic compensation”. We have never mentioned it, and we have also asked the counselor whether he has made such a statement to the other party, and he clearly stated that he has not.

These factual errors have greatly misled public opinion. After we reported the case on October 11, the female student also repeatedly avoided the police’s summons and inquiries.

After communicating with a lawyer to collect evidence, it was found that at 5:00 p.m. on October 11, two hours after the female student published the WeChat article (before the first hot search), a lot of absurd and untrue information suddenly appeared on the Internet:

1. Rumors that my son’s father is Xiao Xinfeng, the deputy district head of Xinzhou District, Wuhan, and his uncle is Xiao Dayou of Dongfeng Group (the government promptly refuted the rumors through media such as Dawang News).

2. Someone impersonated a high school classmate, fabricated a high school life and study history, exposed the child’s personal information and photos, fabricated various so-called “black materials”, from maliciously P-ing pictures to fabricate my son’s apology statement during high school (my son never released related content), fabricating a joint petition in the high school girls’ restroom (the high school teachers can all confirm that it is purely fabricated), to writing an article about his own grandfather’s life experience and being said to be plagiarism, and so on.

These false information were all released before and after the first hot search appeared. After the official refutation of the rumors, there were basically no new revelations, and the accounts that released these false revelations either canceled after release, or were overseas, or maliciously released more than 60 articles within three days, and continued to forward each other.

Such dense and sudden false revelations, combined with the timing, may have a planned trace. I don’t know what kind of cruel external force I am facing, with such a strong organizational and planning ability, hiding deep in the Internet, calling for wind and rain, and inciting public opinion. And my son can only suffer harm in this extreme inequality of strength and size.

We are not public figures, just ordinary people. Ordinary people are often powerless and weak when they are hit. Just like the mother who committed suicide by jumping off a building in Wuhan before, even if her child was hit and killed on campus, she still had to suffer cyber violence. Even if she paid the price of her life, it is difficult to compete with the outside world.

Today I stand up, I have made psychological preparations. We will take up the weapon of the law and comprehensively sue for rights protection through judicial channels. This is also the only hope for the child to live! Perhaps the process of rights protection will be long, and may even bring a second injury, but we still have confidence to wait for the truth to come out. We believe in judicial justice, and we also believe that the truth will definitely be seen.

Returning to the incident itself, the point that everyone is most concerned about should be: did the male party masturbate in front of the female party.

It can be glimpsed from three angles:

1. In the 5 videos provided by Yang Mou, 4 valid videos show that Xiao’s upper body is above the table, and his left hand reaches towards his thigh roots and crotch several times, rubbing with his fist through his pants in small movements. In one of the videos, his legs have a contraction movement. In these 4 videos, the rubbing time is 75 seconds, 13 seconds, 10 seconds, and 32 seconds respectively (which is more in line with the characteristics of scratching). At other times, he retracts his hand above the table. However, due to the limited video perspective, it is impossible to fully reflect Xiao Moumou’s complete movements.

(Yang Mou’s video spans nearly two hours. Although there is no academic conclusion, only a very few people should be able to masturbate continuously for two hours in a public place like a library)

2. Xiao Moumou’s mother said that Xiao Moumou has had atopic dermatitis since childhood and often suffers from eczema. She provided chat records with medical staff, pharmacies, and friends asking about eczema treatment since 2020, as well as records of contacting a familiar pharmacy to buy medicine at the end of April 2024 and being told that a prescription was required, and also provided Xiao Moumou’s medical records to prove his history of skin disease.

3. Xiao Moumou’s lawyer organized 5 experts from the urology and andrology departments of Tongji Hospital and Union Hospital to discuss the behavior in the 5 videos. The expert’s opinion is that the scene of the incident was a reservation-based library, and the male student did not intend to target a specific female student; masturbation requires a fantasy object, and there was no communication between the two parties within a few hours of the incident, and the male student had no eye contact or physical contact or communication with the female student, and no behavior to force the other party to cooperate; the male student’s behavior was not the usual hand, and the characteristics of the movement, rhythm, and long-term interruption do not conform to the characteristics of masturbation; the male student has a skin disease in the scrotum, and will unconsciously scratch, and the male student also had the action of scratching when the female student left in the video. Therefore, the 5 experts believe that the behavior in the video does not constitute masturbation, masturbation, or playing with oneself.

In addition, Xiao Moumou’s mother also produced a series of Xiao Moumou’s award certificates, transcripts, and testimonials from mentors and classmates to prove that Xiao Moumou’s grades were excellent—the recommended admission ranking in high school was 22nd in the grade and 1st in the class, and he was admitted to Nankai University at the same time. His GPA at the end of the university term was 3.9, and he also provided a video screenshot of Xiao Moumou watching a lecture by a famous law exam teacher at 7:28 p.m. on the day of the incident, indicating that he was studying intently at the time. (Of course, this can only be used as supporting evidence)

In summary, I am more inclined to the court’s reason, that is, Xiao Moumou has a 99% or more probability of not masturbating in front of Yang Mou.

A subsequent version that spread widely is that the male student had mental problems (PTSD is a mental illness with a clear neurobiological basis), his grandfather was cyber-bullied to death, his grandfather was diagnosed as a vegetative person, and his parents lost their jobs (the latter three are unconfirmed, and it is estimated that they are rumors).

The female party, on the other hand, not only graduated smoothly and applied for a PhD abroad, but also reportedly released the judgment containing the male party’s personal information after the first instance, as well as the following arrogant remarks:

Seeing this, I believe everyone can reach a basic consensus on “the male party is a proper victim”. Regardless of gender, false accusations, rumors, and the disclosure of personal privacy… any one of them is enough to make a person “socially dead” in the present, and it is difficult to prove oneself in the short term, and the road to rights protection is long and long.

From secretly filming my sister and doing indecent things to my sister, to molesting my sister… Looking back from God’s perspective, if the male party involved had 10% of the skills of the female party, or the “guy in Chengdu who was mistaken for secretly filming because of the reflection of his shoes”, or reported the case on the spot, he would not have dug such a big hole for himself.

Xiao’s letter of apology is hard to believe is the wording of a college student, which also proves the statement of his mother.

But the “victim is guilty” theory does not hold water, especially for freshmen who have just entered university. A considerable number of students, not to mention fighting back and defending themselves with professional knowledge (law), may have already withered the moment they saw their senior sister.

This stems from the relatively oppressive social environment in high school, and is also closely related to the education received from childhood, but practice has proved that the idea of avoiding trouble and taking a loss is not feasible in contemporary society.

Not being an honest person and not suffering in silence is the first step in living out the value of united front.

What is most speechless is the attitude of Wuhan University—a troublemaker and a mediator. As a C9 university, after organizing experts to demonstrate and reaching the conclusion that “the male party has no sexual harassment behavior”, it still made a punishment decision in order to quell public opinion, and from beginning to end, it did not play the positive role it should have.

In summary, I hope that when everyone encounters similar incidents (sexual harassment, false accusations), they can bravely report to the police for evidence, not “negotiate” privately, so that it is not easy to leave a handle for cyber violence.
