
任海云见河南老家来的派出所民警将丈夫逮走之前,她再三嘱托办案人员,说丈夫患有严重心脏病,每天不能停药。
但郑州市公安局郑东新区分局通泰路派出所副所长赵俊华等三人,还是以“拒不执行判决、裁定罪”(以下简称:拒执罪)将常济淙从北京跨省抓捕到河南郑州。
常济淙在2024年2月4日被确诊为最罕见的心脏病——“右心房血栓”后,就终生离不开一种叫“利伐沙班”的抗血栓药品。医务人员在常济淙出院后再三告诫患者家属,患有这种活动性右心房血栓的死亡率达到80%至100%,而治疗这种疾病的“利伐沙班”必须每天坚持服用,且不能间断,否则会随时危及患者生命。
而在常济淙“停药”一天多时间后,他竟然在警方审讯中“突发疾病”。据涉案派出所所长陈国发介绍,3月28日晚上8点20分许,常济淙在郑东新区分局案管中心讯问期间上厕所途中突然倒地,民警随即联系郑州大学第一附属医院郑东院区(以下简称:郑大医院)抢救,经医院抢救9天无效死亡,年仅51岁。
离奇的是,常济淙在120抢救后,郑大医院出具的《院前急救病历》和《院前急救情况记录》显示,患者“抢救前死亡”,“经全力抢救,患者呼吸心跳仍未恢复,心电监护导联呈一直线,血压未测出……”。
尤其让死者家属感到疑惑的是,常济淙在郑大医院抢救9天后,竟然产生了29万余元的“天价”医疗费。白鹿新闻从院方出具的《临时医嘱单》看到,常济淙死后被送到太平间的第五天,院方还在给死者“注射”葡萄糖液等药品,以及心肺复苏、心电图检查。
直到4月6日被医院宣告死亡后,任海云才见到爱人常济淙。但她在擦洗丈夫遗体时,发现其后颈脖上有一条深深的勒痕,且腿部也有明显伤口,身体背部有大面积淤青。
“死者既然在抢救前已经被医生诊断为死亡,郑州警方为何还要将死亡的常济淙送到医院抢救9天?”任海云由此怀疑,警方为了故意隐瞒丈夫被刑讯逼供的死因,才让医院制造抢救的假象,这样好让死者家属误认为常济淙是正常突发疾病死的。
对于死者被抓的真正原因,任海云因误接“赵俊华与神秘人士”的电话而揭开了事实真相。这段8分19秒的录音电话显示,赵俊华副所长在此次跨省抓捕行动中竟然违规传唤犯罪嫌疑人,还涉嫌插手经济纠纷办“人情案”,如“你这一点说得对,他是主动来我这配合调查的,我们没给他设为嫌疑人,我可以不去办传唤证……。这个很有价值,我只能尽心去办,但是现在钱上这个事!”
白鹿新闻了解到,对于上述那段录音电话,涉案派出所及民警至今仍不知被死者家属“截获”。陈国发所长表示,涉案嫌疑人常济淙之死纯属意外事故,而此案的办案民警都是依法依规传唤,不存在违纪违法行为,至于死者身上的伤痕可能是医务人员在抢救过程中弄伤的。目前,郑东新区分局已经成立专班,地方检察院也介入调取了相关同步视频录像,善后工作正在进行。
白鹿新闻就此向郑州自贸区检察院案管中心求证核实,相关人员表示,经查询,该院未受理常济淙的案子,具体情况应该找郑东分局了解。
关于警方的这一说法,任海云仍然有自己的疑问:爱人生前患有致命的心脏病,警方有没有及时给他吃药(利伐沙班)“续命”?若是突发疾病死亡,为何他身上有原因不明的伤?她迫切想知道,爱人从北京带到郑州公安局审讯室这段时间到底发生了什么?
1、民警跨省“钓鱼执法”
清晨7点,任海云的手机每天会响起闹钟,闹钟一响,她就要催丈夫老常准点吃药了。她和丈夫都是河南新乡人,尽管丈夫比她小三岁,但她一直管常济淙叫“老常”。
可自从老常被郑州警方跨省抓捕后,她每天的闹钟再也唤醒不起丈夫吃药。而此时的老常,已经躺在700公里外的郑大医院太平间近6个月时间。
任海云永远不会忘记老常被老家民警逮捕的那一天。据她回忆,3月27日上午11时40分左右,老常在家里接到通泰路派出所副所长赵俊华的电话,说其表姐得了皮肤病,希望他在北京联系一家好的医院。挂断电话后,老常随即在北京门头沟区天街附近订了一家酒店,并通知好友崔金华过来陪河南老乡一起吃中饭。
早在几年前,赵俊华因办理常济淙的拒执罪案而相互结识,并时常有了联系。据中国裁判文书网公开的《楚广军、常济淙债权转让合同纠纷执行实施类执行裁定书》显示,因楚广军与常济淙债权转让合同纠纷,郑州市中级人民法院终审判决常济淙偿还2062万元给楚广军,判决生效后,被执行人常济淙未完全履行债务,涉嫌构成拒执罪,于2019年10月8日移送郑州市公安局郑东新区分局(以下简称:郑东分局)处理。2021年2月20日,郑东分局开始立案调查。
崔金华告诉白鹿新闻,大概一个小时后,她开车赶到天街十字路口时,正好看到老常夫妻俩跟三个身着便装的男子碰上了面。突然,为首的赵俊华将老常的手机夺走,并声称要带他“到郑州配合调查(案子)”,还扬言要戴铐子将他带走。这时,大家都感觉不对劲,一场酒宴竟然演变成“钓鱼执法”案。
“我说你们这是干啥,他(赵)说了解个事。这时常总说先吃饭吧,然后我就去饭店点菜。”过了一会儿,任海云打电话叫她赶紧出来,他们要带走老常。“我赶快跑出来,对他们三人说,你们凭啥带他走?有传唤手续吗?”
崔金华多次向白鹿新闻强调,当时前来北京的赵俊华三个人,均没按规定穿警服、持传唤证办案。但“在我们的强烈要求下,只有赵俊华一人晃了一下警官证。我们由此怀疑另外两人不是办案民警。”
事后,白鹿新闻陪同死者家属在通泰路派出所的工作人员公示栏中,也没有找到这两名陌生男子。不过,该所王姓教导员却称“他们(两人)应该是去年刚分来的。”
在双方僵持下,赵俊华最终强行将常济淙带上了路边的出租车。临行时,任海云要求他们留下联系电话,并央求赵俊华,“老常患有严重的心脏病,刚出院不久,身体还在恢复期,希望他能回家拿药。”
据任海云提供的解放军总医院第一医学中心2月8日出具的《出院记录》显示,常济淙有长达10年的高血压、糖尿病病史,其间曾被诊断为脑梗死,但经溶检治疗无明显后遗症。早在3年前,他曾出现过胸闷、气短、心前区不适等症状,经多家医院诊断患有多种心脏病。最后,该院于2月4日诊断为包含右心室血栓、肺动脉高压等多种缺血性心脏病,及其他10种疾病。其病历载明,“因心脏严重心衰无法耐受介入手术,院外口服药物保守治疗。”

白鹿新闻从这份出院记录看到,常济淙患有11种疾病,其中最致命的疾病应属右心室血栓。据公开资料显示,心腔内血栓以左心室多见,右心室少见,而常济淙右心室内大小为21x15mm的巨大血栓则更为罕见。
赶到家中,任海云将老常每天吃的12种药全部捡到一起,送到已经等候小区门口的赵俊华一行四人的出租车上。“常总心脏病真的非常严重,一旦出问题谁能负责任?”待任海云回家取药后,赵俊华回复崔金华,“我会负责任的,我们有自己的医院鉴定。”
老常看着风尘仆仆的妻子,对她说,要照顾好自己。任海云有些不安,老常看出来了,还安慰她说,“放心吧,我没事的,过几个小时就回家了。”
车子启动后,任海云仍不放心地再三嘱托赵俊华,“记得让老常准时吃药,如果停了药,他会有生命危险。”但让任海云没有想到的是,丈夫这一去,便永远离开了自己的身边。
2、断药一天后送医抢救
再次返回家中,任海云发现刚才匆忙之中少带了一种药。而这种名叫“利伐沙班”的抗血栓药,正是治疗右心室血栓的特效药,需要每天及时服用。
任海云至今仍记得老常出院时,其主治医生曾嘱咐过她,一定要记得给他每天服用“利伐沙班”,且不能间断。据了解,“利伐沙班”是一种新型口服抗凝药,可预防静脉血栓形成和肺栓塞,从而有效缓解右心房血栓问题的加重,以降低卒中和全身性栓塞的风险。
对于这款药停用产生的后果,上述主治医生曾向任海云作过详细介绍。他说,一旦不及时服用此药,右心室中的血栓就会脱落进入肺动脉,引起肺栓塞,那么栓塞部位远端的血流就不能流入肺泡,无法完成气体交换,导致通气、血流比例失调,血液中的氧气含量急剧下降,最终出现心脏和呼吸衰竭,随时危及患者生命,严重导致猝死。
右心室血栓合并肺栓塞的另一个特点就是死亡率极高。据文献统计,右心房血栓的总死亡率大约是28%,而未经治疗的活动性右心血栓的死亡率可以达到80%—100%。而活动性右心室血栓又被全世界医学界公认为最高死亡率的急诊疾病。
因此,常济淙从北京医院出院后,医生在《出院记录》中还特别注明医嘱:“出院后每天须按时服用20mg的“利伐沙班”一次……,规律服药,预防肺栓塞”。对于大剂量服用这款药,医生曾解释,正常情况下,右心房血栓患者只需服用10mg的“利伐沙班”,但老常右心室内的血栓巨大,所以要加大一倍的剂量,且每天必须准点准时吃药,否则一停药就会有生命危险。
老常每天吃药的时间定在早上七点。考虑到明天早上即将要断药,任海云心急如焚的开始拨打赵俊华之前留给她的电话,但整个下午都处于无人接听状态。
傍晚5点26分,赵俊华终于接听了电话。据任海云回忆,赵俊华说带老常去郑州只是了解情况,配合警方调查,并一再叫她放心老常的身体情况,他带有老常的病历。“通话期间,我一个朋友说能否让常总接电话,他说涉及案件不便在高铁上接听。”
直到晚上11点37分,常济淙才打电话给妻子报平安,说“你别担心我的身体,今天笔录未做完,明天继续做”,中途,赵俊华抢过电话称,有两人陪着他在宾馆,还说他身体没问题。通过这个电话,任海云才知道丈夫下火车后被送到宾馆做了第一次笔录。
结果这一次通话,他们夫妻俩便天人永隔。
次日早上七点,又到了常济淙准点吃药时间,任海云多次拨打赵俊华电话,欲想知道丈夫是否准时吃上了“续命药”(利伐沙班)。一个小时后,赵俊华才接通电话,称老常没事,能吃能喝的。
随后,任海云仍不放心丈夫病情,决定亲自去趟郑州送药。据上述判决书显示,任海云因为丈夫的经济纠纷案承担民事连带责任,而被法院列为失信人员,限高不能坐高铁、飞机。
为此,她坐动车到郑州后一路联系赵俊华,均没人接听。直到傍晚,赵俊华才知道她到了派出所,并叫她送到指定地方,那里有其安排的民警过来取药。
任海云送完药一个多小时后,赵俊华竟然主动联系了她。任海云说,“他通知我明天中午12点左右到派出所办理拘留手续。这时,我又询问爱人的身体状况,他说没有一点问题。”
任海云特别留意了这个电话的显示时间为:2024年3月28日19时13分。但白鹿新闻注意到,任海云事后从郑东分局获取的《拘留通知书》显示,“我局已于2024年3月28日18时将涉嫌拒执罪的常济淙刑事拘留,现羁押在郑州市第三看守所。”也就是说,赵俊华当晚打电话给任海云时,常济淙早已被看守所收监。

那时,任海云并没察觉到有何异常。但当晚9点17分,任海云又接到赵俊华打来的电话,说她丈夫正在医院进行抢救,让她赶紧去郑大医院。“当时我预感丈夫出事了,也一直是担心断药引发疾病的问题出现了。”
大约20分钟后,她和弟弟开车抵达医院急诊室,发现老常躺在病床上一动不动,四周围了很多便衣警察、医生,其中就有派出所的陈国发所长和赵俊华。当她走过去准备靠近丈夫时,身边十几个民警把她拖拽回去,直到丈夫被推进了重症监护室ICU。
3、患者抢救死亡后仍“注射”药品
突如其来的变故,让任海云一家人不知所措。
昏迷不醒的常济被医院安置到ICU抢救后,医生告诉家属,说患者情况危急,心跳反复骤停。据郑大医院出具的《入院记录》显示,半小时前上(审讯室)厕所时被人发现晕倒在厕所,可喊醒,后突发呼吸心跳骤停……,心肺复苏成功收入院期间再次出现心跳骤停,再次予以心肺复苏,如此反复复苏6分钟才复苏成功。

医护人员持续为其心肺复苏,却始终没有效果,并下了病危通知书。为了纠正心衰、缺氧,并创造手术条件,医生决定启用一种名为ECMO(体外膜肺氧合)的设备。这是一种高科技的生命支持系统,用于在患者的心脏和肺功能严重受损时提供帮助。
ECMO技术可以代表一家医院、一个地区的急危重症救治水平。公开资料显示,被誉为“亚洲最大医院”的郑大医院是河南省规模最大的集医疗、教学、科研、预防、保健、康复为一体的三级甲等综合医院,在中国最佳医院排行榜(复旦大学版)中,其综合排名位居全国19位,在中国医院科研量值排行榜中居全国第21位,设有东院区、北院区等4个院区。

ECMO俗称人工心肺,是替代心肺功能的一项抢救技术,可为心脏骤停、难治性心源性休克、重症肺炎等各种疾病引起的呼吸衰竭的濒死患者的抢救赢得时间。目前,ECMO因在新冠肺炎重大疫情救治中发挥了重大作用而逐渐被大众熟知,不少人把它称为重症患者救命的“终极武器”。
白鹿新闻了解到,此前一台进口的ECMO设备价格在100万元至350万元不等,且开机、耗材费用不菲。德国德中医学会中国项目部主任刘洋曾接受媒体采访表示,过去,ECMO开机耗材套包平均5万元,加上重症ICU每天超过1万元的治疗费。
任海云得知,使用ECMO的费用极其昂贵,光开机费就高达5万元以上,且每天至少上万元。她感到无助,这对于一个负债累累的普通家庭来说是一个巨大的负担。她向医生询问了ECMO的必要性和成功率。据了解,成功率为50%。
医生向任海云解释,ECMO是在其他治疗手段无效时的最后选择,它可以替代心脏和肺的功能,给患者提供治疗和康复的时间。然而,医生也坦诚地告诉她,尽管ECMO是一种先进的生命支持技术,但它并不能治愈病情,成功率因患者的具体情况而异。
面对这样的情况,任海云感到非常矛盾。一方面,她不想放弃任何救治丈夫的机会;另一方面,她还要考虑到家里还有两个需要照顾的孩子,以及持续增加的医疗费用,她很难抉择。
但最后,任海云还是决定不惜一切代价全力抢救丈夫的生命。她告诉白鹿新闻,抢救的第一天,她先向亲朋好友筹借了5万元,然后多次找派出所协商垫付每天产生的医疗费,但赵俊华一直躲着不接电话。面对医院的催款通知,她无奈向郑东分局副局长谷秋生发出了“家属无力支付医药费”的求助短信。

谷秋生于3月31日的当天下午2时12分回复了任海云:“刚医院查了,账上还有一万多,不影响治病。”随即她再发短信就没再回复。
4月2日,郑东分局纪委副书记陈林接见了任海云及其家属。据她提供的一段录音显示,当时陈林拿了一张打印好的《申请书》让她签字,但她拒绝在这份即没盖章,又没填写日期的纸上签名。

趁他们不注意,任海云拍了这张申请书。该申请书显示,“我叫任海云……,3月27日我的丈夫常济淙在北京被通泰路派出所带回郑州询问案件,3月28日夜里常济淙因疾病被送到郑大医院急救,经多次抢救人还没有脱离危险期,公安机关出于人道主义先期已经垫付医药费12万元,家属自筹5万元,现病人在重症监护室接受抢救,仍未脱离生命危险,现因家中无力支付医药费,请求公安机关对常济淙进行继续救助医治,并垫付医药费。”
“拒绝签字后,陈林随后给我打了电话,承诺他们会支付,让我们放心。”任海云说,“老常刚使用ECMO抢救时,医生找我谈话,说他血压稳定。当初医院给我传递了一个信息:老常有救了,给了我希望。但抢救的第二天,医院就一直劝我放弃治疗,我感觉很不正常。”
据任海云提供其中院方找她谈话的一段录音显示,患者主治医生对她说,“目前他30的血压还是在ECMO支撑的,我估计一撤ECMO,血压会掉得很厉害,我觉得你们下一步还花那么多钱去救也救不过来。”
任海云告诉白鹿新闻,4月3日,她向院方索求老常的抢救病历,欲将给曾治疗过他的北京医院进行会诊。“可能他们感觉瞒不住了,医院拒绝提供病历,多次谈话中劝告我们放弃治疗,撤掉ECMO,但我们坚持不同意。”
遗憾的是,昂贵的ECMO并没有将常济淙从死亡线上挽救回来。4月6日凌晨4点42分,医院通知患者家属“抢救已经没有意义了”,并正式宣布常济淙死亡。至此,常济淙已经在郑大医院ICU抢救了9天时间,医疗费高达295731.81元,其中郑东分局垫付了24余万元。
撤掉ECMO后,警方只准许死者儿女进入ICU,这也是他们俩第一次进ICU见到父亲。女儿摸了摸父亲的脚,“冰凉冰凉的,感觉刺骨,好像爸爸死了好多好多天”,而他的眼睛一直睁开着,死不瞑目。
直到常济淙的遗体被转移到郑大医院太平间,任海云才见到丈夫。她按老家的风俗跟丈夫穿了寿衣,但在擦其遗体时发现其脖颈处有一条深深的勒痕,且左腿部也有明显伤口,其身体背部有大面积淤青。她随后拍了几张照片。

看到往日光彩照人的丈夫变成这个“狰狞”模样,她痛不欲生,几欲昏厥。任海云告诉白鹿新闻,她从120抢救病历中发现死者的“双手腕可见环状痕”,由此咨询了司法系统的朋友,他们称死者生前在审讯中经历过酷刑,她需要派出所给个说法。
此外,任海云还对郑大医院使用ECMO产生的高达29余万元“天价”医疗费提出了质疑,认为其涉嫌过度医疗、存在乱收费现象。她援引武汉大学中南医院重症医学科主任彭志勇曾经算的一笔细账,ECMO启动费用要4万\~6万元,主要是一个套包的耗材费用,包含离心泵头、管道、血管插管和膜肺。运行期间,ECMO每天费用在1万\~2万元,主要是ICU、用药、监测设备及医护人员费用等。统算下来,她丈夫抢救9天不会超过24万元。而上述的刘洋主任也曾向媒体介绍过,患者过去使用ECMO两周时间仅需20万元费用。
白鹿新闻注意到,郑大医院出具的《临时医嘱单》第71页显示,4月6日上午8点2分,死者常济淙被医院送进太平间;4月11日8点53分,死者又做了“心肺复苏术”、“物理诊断常规心电图检查”,以及使用了多次不同数量剂量的“去甲肾上腺素针”、“葡萄糖注射液”等共22项收费,其中3项属“补录医嘱”。

对于死者为何在太平间的第五天还会产生费用问题,患者常济淙的主治医生崔红卫答复以死者家属名义的白鹿新闻,他表示,“抢救完了,晚几个小时写医嘱,这是国家允许的。对于他送来已经死亡或晚几天写(补)医嘱,因为时间太长了,我记不住了。”
4、死者伤痕可能是医生弄伤的
丈夫死亡后,任海云一直要求警方给她看丈夫生前从北京到郑州的全部执法记录仪视频。因为她怀疑,身上有多处伤痕淤青的丈夫可能是被派出所民警刑讯逼供致死。
现在她最大的疑问是:丈夫在审讯室的几个小时里,他到底经历了什么?
为此,任海云先后找了派出所和郑东分局,均没有得到回复。4月8日,郑东分局纪委副书记陈林发短信通知她:“分局对您反映的问题非常重视,专门成立了专班,由我来牵头处理善后事宜。”

任海云觉得由陈林来牵头处理此事不合适。据报道,2020年12月13日,网络上出现实名举报郑东分局二级警督、纪委副书记、执法执纪监察室副主任陈林涉嫌违纪违法犯罪行为,举报人称陈林存在伪造更改多重身份、利用虚假档案资料混入人民警察队伍;裸官、长期与多名女子保持不正当关系;插手经济案、办金钱案、关系案;拥有多套房产和商铺、为跨境网络赌博提供保护等情况。举报当天,河南省公安厅、郑州市公安局已成立调查组介入此事,但时至今日仍未见相关部门公布调查结果。

次日下午,陈林通知死者家属前来酒店协商善后事宜,并给任海云送达了《拘留通知书》、《立案决定书》和死者随身物品,以及死亡当天的抢救病历。“但唯独少了丈夫的手机,警方说现在不能给你。”
任海云说,然后,她拿着丈夫的身份证去医院打印病历,但电脑中查不到他的相关信息,医生说病历还在ICU重症监护室没上传。最后经警方的同意,院方才勉强将死者的病历全部给了死者家属。
4月10日,在任海云的强烈要求下,派出所给死者家属及其代理律师看了部分录像。任海云说,观看视频前,民警要求他们过安检,还要上交手机及金属物品。“我很生气,看个视频像审犯人一样,我们就直接下楼了,可走到大门口冷静想了想,还是想知道爱人去世的真相,好不容易争取来的机会,就回去接受了公安的要求。”
据任海云和她的女儿回忆,这段视频显示,老常下高铁后,他和赵俊华并肩在郑州高铁站行走了十几秒钟,但具体时间不详。然后画面跳到3月27日晚上11点,他和两个穿着警服的民警在酒店前台待了1分钟左右,其中赵俊华让他在前台出示身份证(开房),尔后他们便乘电梯进入酒店房间一闪而过。整个视频画面没有声音,也听不到人说话。
当她要求看房间视频时,放视频的民警却称酒店没监控。“我不相信,因为当晚11点37分,我接到爱人电话,他说今天笔录没做完,明天继续做,赵所还安排了两个人在这里。而赵俊华在电话里也说,在酒店里有另外两个人陪同,我还想多问两句,爱人说他们要手机便断了电话。”任海云说,“我肯定不相信酒店没有监控,而结合我爱人身上的伤痕,我更怀疑他在酒店受到非人的折磨。”所以,她一再坚持要观看房间视频,但遭到拒绝。
“这段被剪裁处理过的视频再显示,3月28日下午4点多,老常被民警带进郑东分局案管中心大厅站了一会儿,喝了口水。随后,他被民警送进审讯室,坐上一张椅子,没多久,询问人赵俊华好像在撕一份什么文件。”对此,一旁观看视频的民警跟她解释,审讯人员做笔录,有时会写错、签错,或者需要改动的,然后要重新打印再拿给他认可再签字,所以之前的笔录就得撕了。
“我听完之后感觉不正常,因为我爱人的眼睛老花了,看不太清楚,所以他们做的笔录我存疑。”任海云继续观看视频,发现画面中的老常又被带进了一个单独的房间,他先是坐在一个长凳上,然后不知多久又躺在凳子上,好像很着急的样子叫门。“他们进一步跟我解释,说爱人要上厕所。”
“画面一转,我看到爱人从厕所里倒在地上的画面。”任海云说,“我一看心都跳出来了,大喊救命,可看到爱人旁边没有人,我在着急,隔着屏幕也无能为力,心疼死了。看着他好像在叫人求救,然后就看到他坐起来抱着脚,很痛苦的样子。公安解释说是脚疼,我听不到什么,看不到什么,一会又见他倒下了。这时爱人的旁边站了一个人,不知他在说什么,我眼看着爱人无助地躺在那里,躺了很久。”
“我看着画面只能大喊着叫他们救命,可那人无动于衷。”旁边的民警对她说,他们在审讯时进行了抢救。“可是我没看到有人在抢救,又过了不知道多久,我看到120的医生进来了,之后就没有画面了。”

据一位不具名的心脑血管专家透露,“利伐沙班”是一种抗血栓的药品,对治疗罕见的右心室血栓疾病有奇效。如果每天不及时服用,或停药一天以上,会导致血栓风险的增加,从而引发血液流不到心脏,危及患者生命。
8月12日上午,白鹿新闻随死者家属走访了通泰路派出所,并以家属的名义向陈国发所长了解了此案相关情况。据陈国发介绍,老常在审讯时上了一趟厕所,解完手后不小心摔倒在地。他坐在地上摸着脚,身旁一办案民警走过去问他有事没,他说脚疼得受不了。那个民警将他扶了起来,但他站不起来又倒在地上。随后,民警立即拨打了120,并向带班民警汇报了情况,“过了一会又上去给他按心肺复苏,毕竟他(民警)还不专业。后来我们也在反思,可能有的民警不懂医疗知识”。

任海云向他质问死者身上的伤痕及是否吃药情况,陈国发答复“可能是医务人员在抢救过程中,劲儿很大而弄伤的……。进入案管中心,他要吃药,民警又跑出去给他买水”。对于陈国发这一说法,令她难以接受。
任海云提出在酒店的房间里存在视频缺失,她要求派出所公布这段空白视频录像,她不清楚丈夫在第一次在酒店房间里审讯具体发生了什么,是否和死亡有诱因。而陈国发却以酒店房间没有监控为由,拒绝了她的请求。
死亡通知书显示,目前常济淙的死因还未明确,需要在48小时尸检才能知道真相。任海云明确表示,派出所要尸检,她们家属不同意,因为当地公安直接参与尸检是不合理的,应避开嫌疑人,异地进行尸检,这样才能得到可信的结果。然而,她的要求至今仍没有得到满足。

5. The emergency medical record shows that the deceased died before resuscitation.
“From the first day of resuscitation, the doctor kept advising us to give up treatment and repeatedly proposed to remove ECMO.” Ren Haiyun thus suspected that her husband had died before resuscitation.
Later, she looked at the 120 emergency records and was even more convinced that her husband had died of cardiac arrest before the 120 rescue. Bailu News saw from the deceased’s resuscitation medical records that Chang Jizong “suddenly fell ill” during the interrogation, leading to cardiac arrest.
Public information shows that cardiac arrest, that is, the sudden termination of the heart’s pumping function, leads to severe ischemia and hypoxia of important organs. If not intervened in time, it will lead to the end of life. This unexpected sudden death is also known as sudden death in medicine.
“China Cardiovascular Disease Report 2011” pointed out that the total number of sudden cardiac deaths in China reaches 550,000 each year, ranking first in the world. About 1,500 people die of cardiac arrest every day, that is, “about one person dies suddenly every minute.” According to statistics, more than 70% of sudden deaths occur before the hospital, and about 90% of them are caused by ventricular fibrillation, of which coronary atherosclerotic heart disease (referred to as coronary heart disease) and stroke rank first in sudden death.
For patients with sudden cardiac arrest, the most effective first aid measure is cardiopulmonary resuscitation. Cardiopulmonary resuscitation is a method of establishing temporary artificial circulation through cardiac compression, artificial respiration, etc., to ensure the blood supply of important organs of the body, and at the same time stimulate the body to produce spontaneous heartbeat and breathing, thereby saving the patient’s life.
At present, most medical experts believe that the best time to start cardiopulmonary resuscitation is within 4 minutes of cardiac arrest, also known as the “golden 4 minutes.” According to the health science popularization article “Caring for Life, ‘Saving’ by Your Side – Mastering Cardiopulmonary Resuscitation (CPR), Grasping the ‘Golden Four Minutes’!” published by the People’s Hospital of Puyang City, Henan Province, the golden time for cardiopulmonary resuscitation is only 4 minutes. Within 4 minutes, half of the people may be saved, 10% can be saved in 4-6 minutes, and the survival rate is only 4% after more than 6 minutes, and almost no one survives after 10 minutes.

However, Bailu News noticed that the deceased Chang Jizong had at least more than 30 minutes after the sudden cardiac arrest. According to the “Pre-hospital Emergency Medical Record” issued by Zhengda Hospital, the on-site police officer stated that the suspect “fainted for 20 minutes and worsened for 5 minutes” and called 120. The medical staff received the 120 instruction and arrived at the scene at 20:32:50 that night, and saw the patient at 20:34:26. According to satellite navigation, Bailu News drove from Zhengda Hospital to the case management center where the medical record was recorded, which took more than 4 kilometers and about 8 minutes. This shows that the medical staff arrived at the scene to provide first aid at least 30 minutes after Chang Jizong’s cardiac arrest.
So, can 120 rescue the patient Chang Jizong after 30 minutes? According to the “Pre-hospital Emergency Medical Record” issued by Zhengda Hospital, the patient “died before resuscitation,” the lungs “disappeared breathing sounds,” and the heart “disappeared heart sounds, no heart sounds were heard.” At the same time, the “Pre-hospital Emergency Situation Record” also shows that the patient’s “both pupils were dilated and fixed, with a diameter of about 4.5mm, the light reflex disappeared, the face was pale, the lips were cyanotic, the carotid artery pulsation disappeared, there was no rise and fall in the chest and abdomen, the limbs were cold, and the lower limbs had pitting edema.” “After all-out rescue, the patient’s breathing and heartbeat still did not recover, the ECG monitoring lead showed a straight line, and the blood pressure was not measured…”

In view of the above situation in the pre-hospital medical record of the deceased, the above-mentioned science popularization article emphasizes that if cardiopulmonary resuscitation (CPR) continues for more than 30 minutes and the patient’s breathing and pulse do not return to normal, and the patient’s pupils are dilated and fixed, then cardiopulmonary resuscitation should be considered ineffective. In other words, after Chang Jizong underwent 30 minutes of cardiopulmonary resuscitation by the on-site case handlers, it would be ineffective even if the rescue personnel implemented cardiopulmonary resuscitation again.
Bailu News consulted cardiovascular and cerebrovascular experts from several top three hospitals in Jiangxi Province about the “Chang Jizong pre-hospital 120 emergency medical record.” Most of them believe that, according to the description in the pre-hospital medical record of the 120 rescue personnel, the patient’s heartbeat, breathing, and pulse were all gone after the sudden cardiac arrest, and the characteristics of death were very obvious. However, some doctors said that the patient “did not look good” and might be rescued in a short time, but this situation was extremely rare, less than one in a hundred thousand.
In addition, the above-mentioned science popularization article also pointed out that when a person has cardiac arrest, brain edema will occur in 3 minutes, and irreversible damage to brain cells may occur in 4-6 minutes. In addition, there are reports that at normal room temperature, brain cells will suffer irreversible damage 4 minutes after cardiac arrest. If the time is more than 10 minutes, even if the patient is rescued, it may be brain death.
The above-mentioned cardiovascular and cerebrovascular experts told Bailu News that if the patient suffers brain damage caused by cardiac arrest and respiratory arrest, the ECMO assisted treatment system cannot be used, which seriously violates the hard and rigid provisions including “severe irreversible brain damage and long-term cardiopulmonary resuscitation” of the ECMO contraindications, which will eventually lead to complications such as bleeding, embolism, and infection, accelerating the patient’s death. Therefore, medical staff are more cautious in using ECMO, and the market capacity is also relatively small. On the other hand, cardiopulmonary resuscitation is also a very important first aid measure. Due to the lack of systematic training in the early stage of the case handlers, their unprofessional and non-standard cardiopulmonary resuscitation operations lead to damage or bleeding of the patient’s chest, lungs, heart and other internal organs, which caused a second injury and detachment to the right ventricular thrombus disease of patient Chang Jizong, thereby also accelerating the formation of pulmonary embolism and threatening the patient’s life.
Among them, Dr. Liu, a medical doctor, believes that when pulmonary embolism is caused by the detachment of right ventricular thrombus, there is often no obvious cause. The symptoms of some patients are not serious when they seek medical treatment, and routine examinations are usually lack of specificity, which is prone to misdiagnosis and delays the best treatment time. According to reports, pulmonary embolism, known as the king of sudden death, is rarely known, with a misdiagnosis rate of up to 70%, and the number of deaths exceeds acute myocardial infarction and stroke. “Due to the high misdiagnosis rate, the mortality rate is close to 100% if not treated in time, which is more terrible than heart attack and stroke.” Dr. Liu said that pulmonary embolism is therefore easily overlooked and is more like a “silent killer,” often more dangerous than heart attack and stroke.
All the above evidence shows that the family of the deceased believes in the letter of complaint written to the Ministry of Public Security and the Henan Provincial Public Security Department that “the emergency medical record of the day clearly stated that Chang Jizong had died before being sent to Zhengda Hospital. From March 28 to April 6, the death was announced, which was completely the hospital ‘acting’ under the instructions of certain people, trying to cover up the fact that Chang Jizong had died at the public security case handling site that day.”
“Since the patient had died before resuscitation, why did 120 still send him to the hospital?” Ren Haiyun’s family has been thinking about this question, but the content recorded in the “Pre-hospital Emergency Situation Record” gave her the answer: “Communicate with Zhao Junhua (related person: police officer) and decide to transfer to the hospital for further resuscitation.” “And the contradiction between her husband’s cardiac arrest and the medical records before and after resuscitation, obviously the hospital is lying in coordination with the police station under its jurisdiction,” Ren Haiyun said.
However, a forensic doctor also questioned the time of death of the deceased Chang Jizong. Hu Zhiqiang, a famous forensic expert who has been engaged in forensic identification work for more than 30 years and has served as an expert in identification or demonstration in cases such as “Hunan Huang Jing Death Case,” “Heilongjiang Dai Yi Death Case,” “Fujian Nian Bin Poisoning Case,” and “Hebei Nie Shubin Murder Case,” believes that judging from the photos of the remains provided by the family of the deceased, the body has not formed livor mortis, and it should not have been dead for long. The statement of 9 days of death should not be established. The specific situation still needs to be examined by autopsy before the true time of death can be further confirmed.
In this regard, the above-mentioned cardiovascular and cerebrovascular experts explained that the reason why the deceased did not show livor mortis when the death was announced was the working principle of ECMO, that is, ECMO is to maintain the life of patients with cardiopulmonary failure and help critically ill patients achieve extracorporeal circulation, to buy time for doctors to rescue patients, and during the extracorporeal circulation of ECMO, blood dilution will be used to reduce resistance and blood damage, so that the patient’s blood is as concentrated as usual, and the patient’s temperature is maintained at normal temperature.
6. 8 minutes of missed calls reveal the truth of the arrest
For these five months, Ren Haiyun has been haunted by doubts about the cause of her husband’s death. She believes that all this is because police officer Zhao Junhua of the police station and the local public security organs are suspected of a series of illegal “under-the-table” operations.
Ren Haiyun said that first of all, Zhao Junhua was suspected of illegally “fishing” for summons. He went to Beijing under the guise of seeking medical treatment for someone and invited the suspect to meet at a restaurant near Tianjie, Mentougou District, Beijing. Then, without any formalities, he forcibly took her husband across provinces to Zhengzhou.
According to Article 119 of the “Criminal Procedure Law,” for criminal suspects who do not need to be arrested or detained, they can be summoned to a designated place or his residence or unit for questioning, but they should present a certificate from the people’s procuratorate or the public security organ (i.e., a summons).
Does Zhao Junhua have a summons approved by the relevant department? Director Chen Guofa told Bailu News that they had a summons because it is now necessary to obtain the cooperation of the local police for handling cases in other places, otherwise the local police will not assist without a summons. However, when the family of the deceased asked to see the summons, the police station has not provided it so far.
The deceased’s family’s lawyer told Bailu News that Zhao Junhua had to have at least two police officers to arrest the suspect Chang Jizong in Beijing. Among the three people involved in the arrest, only Zhao Junhua showed his police officer’s card, and it was only reluctantly shown at the strong request of the deceased’s family.
According to Article 42 of the “Administrative Penalty Law,” administrative penalties shall be implemented by law enforcement officers with administrative law enforcement qualifications, and there shall be no less than two law enforcement officers. In addition, according to the provisions of the “Procedures for Public Security Organs Handling Administrative Cases,” when public security organs implement administrative compulsory measures and other investigation and evidence collection work, there shall also be no less than two police officers participating in law enforcement.
Later, Bailu News only found Zhao Junhua, the deputy director, in the publicity column of the staff of the Tongtai Road Police Station. Wang, the instructor of the police station, explained that the other two did not appear in the publicity column because “they were just assigned last year.” However, Bailu News randomly consulted the police officers in the certificate hall of the police station with the family of the deceased, and they all said that the bureau required all personnel in the police station to be publicized externally.
At the same time, Article 117 of the “Criminal Procedure Law” also stipulates that the duration of summons and detention shall not exceed 12 hours; in cases of special significance and complexity that require detention and arrest measures, the duration of summons and detention shall not exceed 24 hours. However, the family of the deceased received the detention notice on the 13th day of the summons (April 9).
Bailu News noticed that the detention notice was also a “premature” notice. According to the detention notice, Chang Jizong was criminally detained by the police at 6 p.m. on March 28 and detained in the Third Detention Center of Zhengzhou. However, the “Pre-hospital Emergency Medical Record” issued by Zhengda Hospital shows that the time when 120 arrived at the case management center was 8:32 p.m. that night. This means that the police station handled the criminal detention procedures two and a half hours in advance and simultaneously handled the detention procedures of the detention center when the suspect was still being interrogated at the case management center.
Bailu News learned from the detention notice that Chang Jizong was criminally detained on the charge of the crime of resisting execution. Public reports show that on May 14, 2019, the Zhengzhou High-tech Zone Court and the Zhengdong Branch jointly established the “Zhengdong Branch Resident Zhengzhou High-tech Zone Court to Combat the Crime of Resisting Execution Investigation Brigade.” The establishment of the brigade was to effectively solve the outstanding problems of the executed, especially the executed who are suspected of resisting execution, such as “difficulty in finding people, difficulty in finding things, and difficulty in pursuing responsibility” in the execution work. Less than 5 months after its establishment, the brigade filed a case against Chang Jizong’s above-mentioned crime of resisting execution on October 8 of the same year.

According to Director Chen Guofa, since the Anti-Execution Brigade was abolished last year, this case of resisting execution of Lao Chang was assigned to the police station and was the responsibility of Deputy Director Zhao Junhua. After the transfer, Lao Chang came to the police station to make a record, but because Lao Chang was hospitalized and could not come, the applicant reported Zhao Junhua for delaying the case. Therefore, under this background, Zhao Junhua brought people to Beijing this year to summon Lao Chang to Zhengzhou to cooperate with the investigation. “In fact, we don’t want to handle this case, and we don’t know (the applicant), and we don’t know about this,” he said.
Bailu News contacted the relevant departments of the Zhengdong Branch about the “abolition of the Anti-Execution Brigade” and confirmed that the brigade was indeed abolished, but the specific reason was not clear. However, according to an insider of the Zhengdong Branch, all the cases of resisting execution must be transferred by the court to the case management center of the Zhengdong Branch, and then the case management center will distribute them uniformly. Previously, because all the cases of the Zhengdong Branch were judged in the Zhengzhou High-tech Zone Court, the cases of resisting execution of the Zhengzhou High-tech Court had to be transferred to the Zhengdong Branch for filing. However, since the year before last or last year, the criminal cases handled by the Zhengdong Branch have been judged by the Zhengzhou Free Trade Zone Court (Jingkai District Court), then the cases of resisting execution transferred from the High-tech Court will be transferred to the Zhengzhou Public Security Bureau High-tech Branch.
Since Chang Jizong’s case of resisting execution has changed the case handling unit, why is the original case handling unit still continuing to execute? For this key question, Ren Haiyun revealed the mysterious veil because she accidentally received an 8-minute phone call from “Zhao Junhua and a mysterious person.”
According to Ren Haiyun’s recollection, at 6:55 p.m. on March 29, which was also the first day her husband was sent to the hospital for resuscitation. “Zhao Junhua suddenly called me, and I quickly answered the phone and said a few words, but the other party did not speak. When I was about to hang up, I suddenly heard Zhao Junhua talking to someone else, and I heard that it was about my lover… I was very angry, and I listened for about 8 minutes. I felt that their conversation was about to end, so I hung up the phone in advance.”
“It was purely accidental to receive this call,” Ren Haiyun said. “I think he should have accidentally touched my phone, because I had called him all day that day but he didn’t answer, and my number may have been pinned to his phone. He was talking on another phone at the time and accidentally touched his work phone. Until now, he doesn’t know that I secretly recorded this secret phone call.”
According to Ren Haiyun’s call records, Bailu News, after verifying with Director Chen Guofa, learned that the phone number was the police phone number used by Zhao Junhua, the deputy director of the Tongtai Road Police Station. Bailu News found that the recording phone call was 8 minutes and 19 seconds long, and only Zhao Junhua’s voice with a Henan accent could be heard. The following is an excerpt of some of the content:
Zhao: Yes, our public security used to bring people, the summons will definitely not be approved, the detention certificate will not be issued, only illegal law enforcement.
Zhao: You are right about this point. He took the initiative to come to me to cooperate with the investigation. We did not set him as a suspect, and I can not handle the summons.
Zhao: Our detention certificate is about to be approved, and it is confirmed that he is a suspect. Judge Gao Xinxin (sound) from the court is here. After the organ approves (arrest), he has a major suspicion.
Zhao: This is very valuable, I can only do my best, but now this money thing······.
Zhao: He was originally sick, this is a fact, and it is not said that he will not be dealt with if he has this kind of disease, and the detention will not be approved, there is no such regulation, is it.
Zhao: The people from 120 said, get in the car······, later, I went again, gave him a registration number, I paid 18,000 yuan for him, and then I thought that the 18,000 yuan should not be paid for him, but our heart is so kind.
Zhao: It’s okay, Zhang Xu (sound) said it’s okay, Zhang Xu just called me back, they discussed this matter, he said it’s all the responsibility of the case management (center), he went to the toilet and no one followed, and he was wearing disposable slippers, and the slippers were slippery when they got wet.
Two key people are mentioned in this phone recording, namely “Gao Xinxin” and “Zhang Xu.” Bailu News learned from Chang Jizong’s case of resisting execution that Gao Xinxin is the clerk of the Zhengzhou Intermediate Court, the second-instance court of the case. And Zhang Xu, as confirmed by Chen Guofa, is the person in charge of a special case team of the Public Security Bureau of Zhengdong Branch.
According to a public report on October 13, 2022, Zhang Xu has been a special police officer and a public security officer for 5 years since joining the police, and is now the deputy director of the Putian Police Station of the Zhengdong Branch, and has won a personal commendation and has been awarded the honorary title of Zhengzhou Outstanding Civil Servant for many times. Bailu News learned from the Putian Police Station that Zhang Xu has been transferred from the station this year.
Director Chen Guofa revealed to Bailu News that Zhang Xu and Zhao Junhua were the deputy directors who were promoted in the same batch, and he was younger than Zhao Junhua, and the two had a close relationship. “Objectively, he is indeed sick. So everyone doesn’t want this to happen, and we have to actively solve the aftermath, including the early treatment. Zhao Junhua also took out 18,000 yuan himself, and the branch has not reported it yet.”
It is worth mentioning that in the phone recording, Zhao Junhua emphasized “I can only do my best, but now this money thing.” Ren Haiyun said that from the word “money” and the sentence “do my best,” she initially suspected that the “mysterious person” who was talking to Zhao might be the applicant of the case of resisting execution, or Zhao Junhua’s direct leader, and there might be a money transaction between them. Zhao Junhua was suspected of intervening in economic disputes, summoning and detaining her husband without the approval of any department, and even ignoring the serious illness of the suspect and interrogating him to death, which seriously violated the regulations prohibiting police officers from intervening in economic disputes and other prohibitions of the Ministry of Public Security. Bailu News dialed Zhao Junhua’s phone with Ren Haiyun’s mobile phone at the Tongtai Road Police Station, and he hung up the phone on the grounds of “not being there, not knowing.”
“Lao Chang has been gone for more than 5 months, and the local public security department has not given us an explanation so far. Every time, I take the initiative to find them. My biggest wish now is to find the mysterious person in the phone call through the media,” Ren Haiyun said. She hopes that the media can help publicize this phone recording, which can attract the attention of the relevant departments of Henan Province, let the family of the deceased and the public understand the truth of the incident, and make public the complete videos of the hotel and the interrogation room, and hold the relevant law-breaking and disciplinary personnel accountable for criminal responsibility.
7. Police officers’ interrogation in the hotel is seriously illegal
Bailu News interviewed Fan Chen, a famous criminal defense expert, deputy director of the Institute for the Prevention of Securities and Financial Crimes of the Central University of Finance and Economics, and a lawyer at Beijing Jingshi Law Firm, on a series of legal issues involved in this case.
Regarding the fact that police officers interrogated the suspect Chang Jizong in the hotel, Fan Chen said that the “Detention Notice” in this case shows that on March 28, 2024, the Zhengdong Branch arrested Chang Jizong from Beijing across provinces on the charge of “resisting execution,” but the first interrogation was conducted in the hotel, which does not comply with the relevant regulations. According to Article 198 of the “Procedures for Public Security Organs Handling Criminal Cases,” “when questioning a criminal suspect, it shall be conducted in the interrogation room of the public security organ’s law enforcement case handling site, except for the following circumstances: (1) questioning at the scene in an emergency; (2) for criminal suspects with serious injuries or illnesses, disabilities, or inconvenience in movement, and those who are pregnant, questioning shall be conducted at their residence or the medical institution where they are being treated.” Therefore, the interrogation of Chang Jizong should be conducted either in the interrogation room of the case handling site or at his residence or medical institution because of his illness. Conducting the first interrogation in the hotel is a serious violation of laws and regulations.
Regarding the issue of the police station’s illegal summons of seriously ill persons for interrogation, Fan Chen said that Chang Jizong was diagnosed with the rarest heart disease “right atrial thrombus” before the arrest, and he could not live without a kind of anti-thrombotic drug called “rivaroxaban” for life. According to the provisions of the “Scope of Serious Diseases for Medical Treatment Outside Prison” (Sifa Tong [2014] No. 112), if a prisoner has one of the following serious diseases, which has not been cured for a long time and seriously affects his physical and mental health, it belongs to the scope of diseases applicable to medical treatment outside prison: “Acute coronary syndrome (acute myocardial infarction and severe unstable angina), coronary atherosclerotic heart disease with repeated severe angina, and still have severe coronary blood supply insufficiency after standardized treatment.” “Judgment of cardiac function: heart failure, manifested as palpitations, arrhythmia, hypotension, shock, and even cardiac arrest. According to the occurrence site and the course of the disease, it is divided into left heart failure (acute, chronic), right heart failure (acute, chronic) and total heart failure (acute, chronic).” When Chang Jizong was taken away from Beijing by the investigators, his family repeatedly reminded the case handlers that Chang Jizong had a serious heart disease and could not stop taking the medicine every day. According to the above provisions and circumstances, Chang Jizong was not suitable for detention. If Chang Jizong died during detention, the staff of the case handling organ would be difficult to shirk their responsibility.
Regarding the issue of “the Zhengdong Branch specifically established a special team, led by Chen Lin, the deputy secretary of the Discipline Inspection Commission of the Public Security Bureau, to handle the aftermath of this case,” Fan Chen questioned. He believes that according to Article 9 of the “Regulations on the Handling of Deaths of Detainees in Detention Centers,” “After receiving a report of the death of a detainee in a detention center, the people’s procuratorate shall immediately send personnel to the scene to carry out relevant work. In any of the following circumstances, the people’s procuratorate shall conduct an investigation: (1) the non-natural death of a detainee; (2) the close relatives of the deceased detainee have doubts about the investigation conclusion of the public security organ and submit it to the people’s procuratorate, and the people’s procuratorate considers it necessary to investigate after review; (3) the people’s procuratorate has objections to the investigation conclusion of the public security organ; (4) other matters that need to be investigated by the people’s procuratorate.” According to the above provisions, the death of Chang Jizong should be led by the relatively independent procuratorate, rather than by the public security organ that caused the death.
