In a certain county in Chongqing, several middle schools have seen blood donation vehicles entering the schools, saying it was a “voluntary blood donation activity for teachers and students”, which was jointly organized by the local blood center and the schools. After the interview, the school responded that: the students who donated blood all participated voluntarily, and there are currently no students reporting serious discomfort due to blood donation.

We all know that even in high school, if you don’t repeat a grade, generally only students in their third year of high school may be 18 years old. Therefore, many netizens are asking this question: The state advocates that the age for blood donation is 18 years old and above, is what you are doing “compliant”?

Even the media simply quoted this sentence and asked whether it was “compliant”.

First of all, I want to say that this is not a matter of compliance, but a matter of violation of the law.

The article “The state advocates that healthy citizens aged 18 to 55 voluntarily donate blood” comes from Article 15 of the “Blood Donation Law”. Many people weaken the problem when they see the word “advocate”, thinking that it is just an advocacy, and it is not illegal even if 17-year-olds donate blood, because it is like a policy suggestion.

“Advocate”, not “must”.

This is very absurd. If you play like this, then the entire “Blood Donation Law” will not know how much will be invalidated. Isn’t it also not illegal to ask a 12-year-old child to donate blood?

Definitely not.

Therefore, if students under 18 are really allowed to donate blood, it is definitely illegal. As for those who have the illusion, they have got the subject wrong. I’ll put it in parentheses, and it will be much clearer:

How about you cross out the content in the parentheses and read it again?

It’s clear now, its meaning is that the state “advocates” you to donate blood, but does not force you to donate blood. But the scope is limited to healthy citizens between 18 and 55 years old.

In other words, if the school dares to let the blood donation vehicle in, and then takes students under 18 to donate blood, it is definitely suspected of violating the law. Rather than a matter of compliance.

After the news report, the local official responded, stating that: the teachers and students who were drawn blood were all over 18 years old and met the blood collection conditions.

ok, so there is nothing wrong with this matter, what else is there to argue about? But the netizens in the comment section don’t think so.

In addition to being over 18 years old, there is another problem, “voluntary”.

In fact, this point is probably not going to be proven now. No matter what, parents will not go out of their way to make trouble afterwards, which is really a pure loss of a thousand enemies and self-inflicted damage of ten thousand. Anyway, the blood has been donated, and it is also free. If you accuse this and accuse that, it will not only be meaningless, but will also make the teachers and leaders feel disgusted with your children.

Simply put, it’s useless and annoying.

For parents, this is something they can’t help.

But I want to ask, students who have not yet entered society have insufficient risk identification ability. In other words, their ability to independently judge whether something should be done or not is still not fully formed, such as the inability to fully assess the long-term health risks of behavior, etc. This is the children in the campus, so there must be guardians.

Then, should we ask the guardian if they want to donate blood?

Under 18 years old, the law directly states, “belonging to persons with limited or no civil capacity“, there is no room for discussion. Bypassing the guardian, even if it is said to be voluntary, it is also illegal.

As for being over 18 years old… In theory, it should not be bypassed either, because in terms of “risk awareness”, there is not much difference between the third year of high school and the second year of high school, they are still in school. But legally, indeed, over 18 years old, you can not ask the guardian.

However, although you can not ask the guardian, in the campus environment, it is undeniable that there is an influence of authority. There are differences in identity between the principal, the director, the teachers and the students. And the words “school”, “teacher”, and “unified arrangement” themselves constitute a strong psychological suggestion, which will lead to some students’ so-called voluntariness, which is actually a choice of compliance.

This may also be the real reason for the outside world, netizens and the media to question: due to some other problems that are often exposed, parents do not have so much trust in the “voluntary” that schools often use.

To give a simple example, below is a case where a primary school in a certain place “uniformly replaced the tableware in the canteen, and students can voluntarily choose whether to use it”. However, a student brought his own tableware but was refused to eat in the canteen, and as a result, he was hungry for many days in a row. After the exposure, the comment section was discussing the word “voluntary”.

A netizen’s example is very appropriate: our school uniforms are all voluntarily paid for, but you must wear them to enter the school gate. Can you say you don’t buy them?

I’ll just say so much. The view is not complicated. I personally still believe that those schools will not let students under 18 years old donate blood. As mentioned above, it is suspected of violating the law, and the cost is too high, which is completely unnecessary.

However, on the principle of “voluntary”, even if it can be self-consistent, even if parents don’t say it, they may still have a grudge in their hearts.

The blood donation vehicle should not enter the middle school.
